A new but little-known change in California law designating aquifers as “natural infrastructure” promises to unleash a flood of public funding for projects that increase the state’s supply of groundwater.

The change is buried in a sweeping state budget-related law, enacted in July, that also makes it easier for property owners and water managers to divert floodwater for storage underground.

The obscure, seemingly inconsequential classification of aquifers could have a far-reaching effect in California where restoring depleted aquifers has become a strategic defense against climate change — an insurance against more frequent droughts and more variable precipitation. The state leans heavily on aquifers, drawing about 40% of its water supply from the ground during an average water year and up to 60% during dry years.

More than $1 billion in state funds could become available to a wide range of projects that replenish groundwater, including flood control improvements and wetlands restoration, according to the Planning and Conservation League and the conservation nonprofit River Partners, which pushed for the designation.

“There’s no question this is a critical step,” said Judy Corbett, a board member of the league. “We’re not talking about [funding] one thing at a time anymore — flood control or recharge or improving wetlands — but now everything.”

The new law also positions local water managers and nonprofit groups to potentially tap Proposition 1 funds – a 2014 statewide bond that dedicated $7.5 billion for water projects – and a sweeping climate resilience bond that Gov. Gavin Newsom and lawmakers are planning for the 2024 statewide ballot.

In the world of environmental policymaking, “natural infrastructure” refers to natural landscape features that provide concrete benefits to the public and to wildlife. Wetlands and floodplains, for example, can slow and retain water to reduce flooding while filtering pollutants and providing habitat for fish and water birds.

Recharge Alone Won’t End California’s Groundwater Drought

After a winter of historic rains, California’s reservoirs are filled to the brim. Rivers are supercharged—and have flooded much of the Central Valley. Weather Whiplash Leads to Dramatic Turnaround of Lake Sonoma

If you wanted to measure California’s change of water fortunes, the boat ramp at Lake Sonoma would be one place to do it.

The lake is the scene of an incredible four-month turnaround, for the very water system where the drought officially started.

“As you recall, three years ago, the governor literally was up at Lake Mendocino,” recalled Grant Davis with Sonoma Water. “Declaring the start of the drought basically, basically April 2021.”

Legal Aspects of Groundwater Recharge: Do We Need a Groundwater Recharge Ethic?

Groundwater is one of the world’s most important natural resources, but groundwater management has traditionally been governed by lax and uneven legal regimes which tend to focus on the extraction of groundwater or groundwater quality, rather than groundwater recharge.

In a January 2022 webinar from Berkeley’s Center for Law, Energy, and the Environment, Dave Owen, professor at UC Hastings School of Law in San Francisco, discusses the many human activities that can affect groundwater recharge, the existing legal doctrines that affect groundwater recharge, occasionally by design but usually inadvertently; and how more intentional and effective systems of groundwater-recharge law can be constructed.

 

Sustainable Conservation: Protecting Water Quality While Recharging Aquifers

Over 600,000 Californians rely on nitrate-contaminated public supply wells for their household water needs.  However, those numbers are even greater as they don’t include the many others who struggle with contaminated groundwater from domestic wells.  Balancing long-term groundwater sustainability and water quality will help California weather future droughts, ensure safe drinking water, and support our thriving agricultural community that feeds the nation.

One tool for groundwater sustainability is groundwater recharge, where water is intentionally spread on the ground and allowed to infiltrate into the underlying aquifer.  However, there is much concern that groundwater recharge can increase water quality issues, especially when the recharge water is spread upon agricultural lands.

FPUD Board, Others Tour Conjunctive Use Project Progress

The Fallbrook Public Utility District held a Nov. 10 tour of the Santa Margarita Conjunctive Use Project.

All five FPUD board members participated in the tour. If a majority of board members are present, an activity must be noticed as a public meeting, and members of the public were also invited to join the tour.

The five Fallbrook Public Utility District board members were given a tour of FPUD’s Santa Margarita Conjunctive Use Project sites May 29.

Because a majority of the FPUD board members were present, it was legally required to be a noticed public hearing and the tour was officially a special meeting of the FPUD board. Although members of the public were welcome to attend they would have been required to remain in their own cars or trucks due to the coronavirus quarantine, but they would have been able to hear the audio communications.

Moving Forward with the California Water Portfolio

The development of California’s water portfolio continues to progress. A presentation at the most recent meeting of the California State Board of Food and Agriculture highlighted the priorities for establishing the state’s water resiliency portfolio. Board President Don Cameron noted that the development of a water resiliency plan for California is going to need to incorporate several different factors.
