County Water Authority Pulls the Plug on Lawsuit Challenging Fallbrook, Rainbow Detachment

What began as a brash legal complaint that millions of ratepayers faced historic damage ended with a fizzle this week as the San Diego County Water Authority voted in closed session to settle a lawsuit filed earlier this year.

The water authority board approved an agreement to end its litigation challenging the plan by the Fallbrook Public Utilities District and Rainbow Municipal Water District to leave the broader agency and join the Eastern Municipal Water District of Riverside County.

According to Public Information Officer Noelle Denke for the Fallbrook Utility District, over the last decade, the San Diego County Water Authority has raised water costs for the Fallbrook and Rainbow Municipal Water Districts by an average of 8% per year.

As a result, the region has lost an estimated 10,000 acres of groves and 1 million trees. And now, water rates could go up 14%.

LAFCO Extends Protest Hearing To June 14

Due to an old address being given out for the mailing of protest letters, causing some of the letters to be returned to their senders, the San Diego County Local Agency Formation Commission is extending the deadline for the submission of protest forms on the commission’s earlier conditional approval to expand Fallbrook Public Utility District’s activated functions to include (a) parks and recreation, (b) street lighting, and (c) roads and streets.

Water Agencies Plan to Abandon Costs, Reduce Supply Reliability

Analysis released today shows that proposals by the Fallbrook and Rainbow water districts to leave the San Diego County Water Authority and annex into the Eastern Municipal Water District in Riverside County would increase costs for water ratepayers in San Diego County, reduce the county’s voting power, and decrease water supply reliability for farms and residents.

Numerous financial, environmental and legal issues that affect property owners and water users across San Diego County are analyzed in the Water Authority’s formal response to the reorganization proposals filed today with the San Diego County Local Agency Formation Commission, known as LAFCO.

Water Authority Board Supports Protections for Ratepayers and Property Owners

The San Diego County Water Authority Board of Directors on May 28 voted to support a comprehensive evaluation of the impacts of detachment proposals by the Rainbow and Fallbrook water districts to ensure that ratepayers and property owners in those districts and the rest of the county are protected from potential impacts and given a meaningful opportunity to engage in the process.

That evaluation – under development by the San Diego County Local Agency Formation Commission, or LAFCO – should cover financial, water supply reliability, governmental, and environmental impacts, and it should ensure that the public and all affected agencies across the region can weigh in, according to the Water Authority Board resolution.
