MPWMD Prevails in Lawsuit Against LAFCO

In the Monterey Peninsula Water Management District’s pursuit of buying out California American Water’s system on the Monterey Peninsula, a small but notable victory was meted out Oct. 25 with a ruling from Monterey County Superior Court Judge Thomas Wills.

The ruling came out of a lawsuit the district filed against the Local Agency Formation Commission of Monterey County in April 2022, centered around a decision LAFCO’s board made in December 2021 in which the board voted 5-2 to deny granting the district the “latent powers” to be a retail water provider.

LAFCO Finalizes Denial of Monterey Peninsula Water Management District’s Cal Am Takeover

The Monterey County Local Agency Formation Commission voted 5-2 Wednesday to finalize its denial of the Monterey Peninsula Water Management District’s planned takeover of California American Water.

The 5-2 LAFCO vote followed its initial vote Dec. 6 to dismiss the water district’s application for the buyout, an acquisition mandated by a 2018 ballot measure.

Cal Am Sues Water Management District Over Public Takeover Report

California American Water has sued the Monterey Peninsula Water Management District challenging the environmental review of the district’s potential public takeover bid of the company’s local water system.
